Michael Harris, a partner and Patent Assassin at SoCal IP Law Group LLP, invalidated a patent owned by a non-practicing entity which had sued his client, a successful manufacturer.  The win was capped by a favorable decision of the Federal Circuit.  In an entertaining but brief opinion, Judge Posner of the Seventh Circuit, sitting by designation, agreed with Mike that the patent was obvious.

The case involved Patent No. Re 38,924 to a Pyrex glass “sex aid.” The court stated:

A more perspicuous term is ‘sexual devices,’ by analogy to ‘medical devices.’ The analogy lies in the fact that, like many medical devices (thermometers for example), what we are calling sexual devices are intended to be inserted into bodily orifices, albeit for a different purpose.

The prior art taught glass sex aids and Pyrex thermometers.

Because Pyrex has well known properties, and the sex aid used those properties, replacing conventional glass with Pyrex in a sex aid “was not a venture into the unknown.” The opinion quoted extensively from KSR. The court also found the case to be a typical substitution of materials case like Hotchkiss v. Greenwood and Stratoflex v. Aeroquip.

Plaintiffs had sought up to $77 million in damages, although their company sold $1¼ million over eight years and Vast Resources only had one year of potentially infringing sales. Plaintiffs’ recovery, zero and their patent invalid. Job well done, Mike!
